CAYMAN ISLANDS: Trusts judgment casts light on protector's powers of consent
The Grand Court of the Cayman Islands has issued an important ruling on the issue of a trust protector's role where trustees can only exercise a power with the protector's consent. The court's decision supports the view that careful drafting in the trust deed can address the question of whether a protector's role is merely to ensure that a trustee's decision is valid or if it includes a wider decision-making discretion. In the case (In the Matter of B Trust - Reasons for Decision, 2024 CIFSd 70) the trustees proposed to appoint assets to a new trust and dispense with the management committee.
