CONTENTIOUS ESTATES: Deceased's text message to will writer was enough to prove deathbed gifts valid, finds EWHC
The England and Wales High Court (EWHC) has accepted Masudur Rahman's claim that his 82-year-old friend Al-Hasib Al Mahmood gave him all his UK assets in the week before his death during lockdown in October 2020. The EWHC ruled that the gifts constituted valid donationes mortis causa, as the deceased had not had time to find witnesses for a new will. Instead, he sent a text message to his will writer stating that the claimant was to be the sole owner of his assets and revoking his previous will (Rahman v Hassan, 2024 EWHC 1290 Ch).
