BERMUDA: Proposals for trustees to keep records of advisors for five years after breaking with trust

Bermuda has begun consulting on proposed amendments to the Trustee Act 1975. The amendments would require trustees to record details of a trust's advisors, service providers and managers, as well as beneficial ownership information, for at least five years after they cease to be involved with the trust. A definition of beneficial ownership is also being added, to meet the new requirements under Financial Action Task Force Recommendation 25 on transparency of beneficial ownership of trusts and similar legal arrangements. Non-compliance penalties of BMD20,000 are to be introduced and will apply to include non-professional as well as professional trustees.
