CAYMAN ISLANDS: Court promises confidentiality will be respected in trust dispute
The Grand Court of the Cayman Islands has reassured litigants that the Cayman judiciary will treat privacy and confidentiality concerns in private trust cases as an exception to the principle of open justice (In the Matter of the A Trusts). The court also ordered that the legal costs of a protector defending an application for their removal should be paid pro tem from the assets of the trust on an indemnity basis, even though the other party argued the 'bitterly fought' proceedings constituted a 'hostile claim' in which the loser should be ordered to pay.
