UAE: Appellate court confirms DIFC courts can issue worldwide freezing orders
Courts in Dubai International Financial Centre (DIFC) have jurisdiction to issue worldwide freezing orders in support of proceedings outside the United Arab Emirates (UAE), according to the DIFC Court of Appeal's ruling in Carmon v Cuenda (2024 DIFC CA 003). In the case, a UAE-based bank challenged a worldwide freezing injunction granted against it by a Hong Kong court, relating to two accounts that allegedly held USD20 million of misappropriated funds. The ruling makes clear that the DIFC courts remain committed to a cautious application of worldwide freezing orders and other interim relief orders, says law firm Charles Russell Speechlys.
