SWITZERLAND: Government to remove FI clients’ right of appeal against international cooperation
Switzerland's Federal Council has published proposals to abolish the right of financial institutions (FI) clients to object when the financial regulator (FINMA) decides to disclose their affairs to other countries under administrative assistance procedures. As an alternative, it may decide to restrict client's appeal rights only where offences such as money laundering are involved. FINMA will also be authorised to request audits of foreign companies not subject to supervision. Foreign supervisory authorities will be allowed to conduct audits in Switzerland. The Federal Council says the proposed amendments are necessary for the 'needs of Switzerland's financial centre' and legal protection of those affected would remain intact.
